18—Conditions (section 45)
For the purposes of section 45(6) of the Act, the penalty for a failure
by the holder of an environmental authorisation to comply with a
reporting-deadline condition is—
(a) in
the case of an environmental authorisation granted for a term of 2 years
or more—the higher of $300 or 5% of the holder's annual authorisation
fee for each month (or part of a month) for which the default continues; or
(b) in
the case of an environmental authorisation granted for a term of less than
2 years—the higher of $300 or 5% of the holder's authorisation fee
(paid on the grant of authorisation under section 40 of the Act) for
each month (or part of a month) for which the default continues.
