14—Reports and protection of information
(1) For the purposes
of section 72(3)(d) of the Act, members of the Safety and Quality Unit of
the Department who are members of the Patient Safety Team are prescribed as a
class of persons who are entitled to receive the following parts of a second
report prepared by an RCA team appointed in relation to a hospital
incorporated under the Act or SAAS:
(a) any
description of the adverse incident;
(b) any
causation statement;
(c) the
recommendations of the RCA team;
(d) any
other material considered relevant by the RCA team.
(2) For the purposes
of section 73(2)(e) of the Act, a person who receives a report under
section 72(3)(b) or (d) of the Act may make such records or use or
disclose such information as is reasonably necessary in order—
(a) to
analyse the report and assess and discuss any incident, contributing factor,
statement, recommendation or other material identified or contained in the
report; or
(b) to
provide information or any report to an authorised quality improvement body.
(3) For the purposes
of subregulation (2), a reference to a report includes a reference to
part of a report.
