penalty is paid it is to be dealt with in accordance with section 86 as if
—
(a) the
modified penalty were a fine imposed by a court as a penalty for the alleged
offence; and
(b) the
offence had been prosecuted by the person or entity who or which is taken,
under section 65(2), to have given the infringement notice.
